Court overturns Prop. 8 in California, says state can’t ban

The 9th Circuit Court in California struck down the state's voter-passed ban on gay marriage, ruling 2-1 that it violates the rights of gay Californians.

"Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples," Judge Reinhardt wrote in the decision. The Court concludes that the law violates the 14th Amendment rights of gay couples to equal protection under the law. Gay marriage will still not be allowed in the state, leaving time for Prop 8 defenders to challenge the decision.

The Circuit Court backed up District Judge Judge Vaughn Walker, who ruled in August of 2010 that the state of California has no "rational basis" to single out gay men and women as ineligible for marriage. The group fighting for Proposition 8, which passed in 2008 after thousands of gay couples had already married, appealed Walker's decision arguing that it should be vacated because Walker is gay and has a long-time same-sex partner. The 9th Circuit Court judges denied this motion.

Walker's sweeping 2010 decision was called a "grand slam" by gay rights advocates, who hoped it would convince the Supreme Court to decide that states cannot outlaw gay marriage. But Reinhardt was explicit in his decision that his court's decision is "narrow" and only relates to California, not to the entire nation. In California, gay people had the right to marry for several months before it was taken away from them by a majority of voters. This amounts to a violation of equal protection because a right was specifically taken away from a minority group, Reinhardt writes. But this argument would not apply to gay people in other states. "It's a strong decision but it is not the ringing endorsement of broader marriage equality that some might have hoped for," Hunter College professor and gay rights advocate Kenneth Sherrill said.

Ted Olson, the former U.S. Solicitor General under George W. Bush who represents the plaintiffs, said at a press conference that the decision is the first step to ending discrimination. "Today we are more American because of this decision," he said.

The pro-Prop. 8 camp has said it will appeal the decision. The group can now ask that all 11 members of the 9th Circuit hear their case, instead of just the panel of three who decided against them on Tuesday. "Today's ruling finally clears the field for an appeal to the United States Supreme Court, where we are confident we will be victorious," the Save Prop 8 campaign said in a statement.

More American.... how does he figure that seeing that America was founded on the Bible by Christian...passing laws that make what is unlawful lawful does not make America more American,but makes America more like a pagan nation ,akin to Baal Worship .....and S&G which God destoyed by fire and brimstone..
The 14th Amendment is not being violated by baning same sex..its being violated when Courts side with lawless acts.. America's foundation is on the Bible and God is the One and ONLY God affimed in our nation's Paper's and Documents..the Judge needs a History lesson..he might want to read his States Preamble also.... pagan god's had no place in America's foundation neither their immoral acts that mock Gods plan for a natural union that was male and female... I can't believe the acts of those having power to change our Laws ..... Laws of nature .....And nature's God who was and is according "ONE NATION UNDER GOD" and "IN GOD WE TRUST" and building's in our nation's Capital have carved in stone Who the God of America is... What about "God save this honorable court"... to make a law that mocks God knowing that America was established for the Glory of God and to advance the Gospel of Christ Yeshua...no to twist and misuse the intent of our nation's laws ,is to defaud America and every person who believes one man one woman ...and I believe a higher precentage of citizens believe one mam one woman including those who are not Christian to hold to moral ethics.. now I just read the XIV Amendment in a book I have " A NEW DAWN OF LIBERTY " The Story of American Founding By GregoryWolfe The law they are protected with is the same law for everyone giving protecting for their life,Liberty and Proerty ..they have equal protection,but the 14th Amendment in no way endorses same sex marriages ..in fact yrs ago opposite sex could not live togather without being married it was unlawful to live togather like heathen in a Christian establish nation..I really do not think that Law was changed... Courts need to be put in their place,they do NOT make laws,they are to enforsed the ones existing..and to listen to a handful of people who do not speak for the 99 % of American's have no right to have extra laws made for them..with that kind of rational every American can demand an extra law made just for their own opinion..everyone has a right to an opinion but Courts /Judges do not make laws that undermind our nation's foundation ,insulting,mocking,trashing the people who founded it and rewriting what the God of America says about right and wrong.....
I know the muderering of babies happened around the world ,I know that same sex existed long ago (also know God burnt the people practicing it ) What has changed is that Laws are being made to make what is unlaw lawful...... and it does not make it right..

What has changed is that Laws are being made to make what is unlaw lawful...... and it does not make it right..
